Munch Through March Madness

If you’re one of the 97+ million U.S. viewers of NCAA’s March Madness, you’re bound to be tempted by typical gameday snacks. Wing orders alone increase by 24% during the tournament, and if your favorite team loses, you’re more likely to indulge in a variety of gameday treats.  Pizza and dessert orders also increase by 19% and 9%, respectively, following losses versus wins. But what about the beer? Three and a half million extra cases of it are produced in March to keep up with demand. ERISA, COBRA and Wellness Programming

Andrews, Attorney for Day Ketterer The threshold issue to determine whether ERISA applies to a wellness program is whether the wellness program rises to the level of a “Group Health Plan.” ERISA defines a Group Health Plan as “an employer-sponsored welfare benefit plan to the extent that the plan provides medical care (…including items and services paid for as medical care) to employees or their dependents directly or through insurance or otherwise.” Many common wellness program initiatives will cause a wellness plan to become a Group Health Plan subject to ERISA, including health risk assessments that provide advice and counseling, employer-paid immunizations and employer-paid biometric screenings (i.e., blood pressure screening, BMI, cholesterol, etc.). Be Well Basic Program

We are pleased to announce the start of a brand new program to provide limited wellness services to those organizations that are A) not ready for comprehensive wellness programming B) not ready to financially support a comprehensive wellness program or C) all of the above. This program will allow every organization, regardless of size, to promote health and wellness internally at a nominal rate. We are now offering the new Be Well Physician Screening Incentive Program: Be Well Basic. The purpose of this program is to encourage participants to get their annual well-visit with their PCP and to reward them for doing so.
